These Terms of Use (“Terms”) are a legal agreement between you and CURECONNECT BUSINESS LLP, operating under the brand Swasthtie (“CureConnect”, “Swasthtie”, “we”, “our”, “us”). They govern your access to and use of our website www.swasthtie.com and related services for booking laboratory tests and health check‑ups (together, the “Platform”).

By accessing, browsing, registering on, or using the Platform in any manner, you agree to be bound by these Terms. If you do not agree, please do not use the Platform or our services.

Swasthtie primarily acts as a facilitator between you and diagnostic laboratories, hospitals and other healthcare providers who perform tests and health check‑ups (“Service Providers”).

2. Definitions

Unless the context otherwise requires:

  • “Platform” / “Website” means our website www.swasthtie.com and any related web pages, forms, SMS/WhatsApp links, or interfaces controlled by us.
  • “User”, “you”, “your” means any individual or legal entity who accesses or uses the Platform, whether for themselves or on behalf of another person (such as dependents, family members or employees).
  • “Services” means the facilitation of laboratory tests, preventive health check‑up packages, home sample collection and related support offered through the Platform.
  • “Service Providers” means third‑party laboratories, diagnostic centres, hospitals, collection centres, phlebotomists and doctors who actually perform the tests, sample collection and interpretation of results.
  • “Appointment” means a booking made by you via the Platform for any Service.

3. Eligibility and Acceptance of Terms

  1. You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872, to use the Platform or book Services. If you book Services for a minor or another person, you confirm that you are legally authorised to do so and have obtained their consent where required.
  2. By registering, accessing or using the Platform, you acknowledge that you have read, understood and agreed to these Terms, along with our Privacy Policy and Refund & Cancellation Policy, which are incorporated by reference.

4. Nature of Services and Important Limitations

  1. Swasthtie only facilitates the booking and coordination of laboratory tests and preventive health check‑up packages. We do not provide emergency care, hospital admission, in‑patient treatment, sale of medicines or surgery.
  2. All actual medical services, including sample collection, testing, analysis, report generation and clinical interpretation, are performed solely by the relevant Service Provider.
  3. The Services and any information or reports produced:
    • Are provided for preventive, screening and informational purposes;
    • Are not a substitute for a full clinical evaluation or ongoing care by your treating doctor; and
    • Do not guarantee absence of disease or future health outcomes.
  4. In case of medical emergency, serious symptoms, or conditions needing urgent care, you should contact emergency services (e.g., 108) or visit the nearest hospital immediately. Do not rely on the Platform or wait for a scheduled health check‑up.

5. User Account, Information and Responsibilities

  1. You may be required to create an account or provide certain details to use the Platform or book Services. You agree to:
    • Provide accurate, complete and up‑to‑date information;
    • Maintain the confidentiality of your login credentials; and
    • Immediately notify us of any unauthorised use of your account.
  2. You are solely responsible for any activity performed under your account, whether authorised by you or not.
  3. You agree not to:
    • Use the Platform for any unlawful, fraudulent, harmful or abusive purpose;
    • Upload or transmit any content that is defamatory, obscene, hateful, invasive of privacy, or otherwise objectionable;
    • Infringe any intellectual‑property or privacy rights of others;
    • Introduce viruses, malicious code or attempt to bypass security controls; or
    • Attempt to gain unauthorised access to any systems, networks or data.

We reserve the right to suspend or terminate your access if we reasonably believe you have violated these Terms or any law.

6. Booking, Payments, Cancellations and Refunds

6.1 Booking and confirmation

  1. You may book Services through the Platform or through our authorised representatives.
  2. All bookings are subject to availability of time slots, Service Providers and locations. We may refuse or cancel a booking if a Service is unavailable or for any other reasonable cause (for example, incorrect information provided, suspected misuse).

6.2 Payments

  1. Prices for tests and packages are displayed on the Platform at the time of booking and may change from time to time. The price applicable to your booking is the one shown at the time your booking is confirmed.
  2. Payments are processed through third‑party payment gateways or banks. Your use of such gateways is subject to their separate terms and privacy policies.
  3. We do not store your complete card/banking details; such information is handled by the payment gateway as per applicable standards.

6.3 Cancellations and refunds

Our Refund & Cancellation Policy for lab tests and health check‑ups forms part of these Terms. In summary:

  1. Before sample collection / centre visit:
    If you cancel within the permitted time window (for example, at least 24 hours before the scheduled time), you may receive a full refund, less any non‑refundable payment‑gateway or processing charges, as specified on the Platform.
  2. Technician visit but sample not collected:
    If our phlebotomist/technician arrives but the sample is not collected due to your unavailability, incorrect address, refusal, or failure to follow pre‑test instructions, a home‑visit or collection fee may be deducted; the balance (if any) may be refunded.
  3. After sample collection:
    Once the sample is collected and processing has begun, refunds are normally not possible. Exceptions may be made if the lab is unable to process the sample or if certain tests cannot be performed; in such cases, a re‑collection, repeat test, pro‑rata refund or service credit may be provided at our or the lab’s discretion.
  4. Delays and no‑show:
    Reasonable efforts will be made to deliver reports within the indicated turnaround time (TAT); significant delays attributable to us or the lab may entitle you to partial relief as described in the Policy.
    If you fail to attend a centre visit or are unavailable for home collection without timely cancellation/rescheduling, the booking may be treated as a no‑show, and fees may not be refundable.
  5. Refund processing:
    Eligible refunds will be processed back to the original payment method within a reasonable time (typically 7–10 business days), subject to bank/payment‑gateway timelines.

The full Refund & Cancellation Policy published on the Platform shall prevail in case of any inconsistency.

7. Role and Responsibility of Service Providers

  1. Service Providers are independent third parties and are solely responsible for:
    • Sample collection, test performance and quality of services;
    • Accuracy and completeness of test results and reports; and
    • Any clinical interpretation, comments or advice attached to the reports.
  2. We undertake reasonable due‑diligence while empanelling Service Providers (such as checking basic registrations and licences), but we do not guarantee:
    • Continuous availability of any specific Provider;
    • That services will always meet personal expectations; or
    • The clinical outcome of any follow‑up treatment or decision based on the reports.
  3. Any negligence or deficiency in medical services should be directly addressed with the concerned Service Provider. We may assist in coordination but are not liable for their independent acts or omissions.

8. No Medical Advice

  1. Content on the Platform (including blogs, package descriptions, FAQs and health tips) is for general informational purposes only and is not intended to be medical advice, diagnosis or treatment.
  2. You should always consult your own doctor or qualified healthcare professional for personalised medical advice, interpretation of reports and treatment decisions.
  3. You should never disregard or delay seeking professional medical advice because of something you have read on the Platform or due to test results delivered via Swasthtie.

9. Intellectual Property Rights

  1. All content on the Platform, including but not limited to text, graphics, logos, icons, images, software, audio/video clips and layout/design, is owned by or licensed to CureConnect and is protected by applicable intellectual‑property laws.
  2. You are granted a limited, non‑exclusive, non‑transferable and revocable licence to access and use the Platform for your personal, non‑commercial use in accordance with these Terms.
  3. You may not copy, reproduce, republish, transmit, distribute, adapt, create derivative works from, or commercially exploit any part of the Platform without our prior written consent, except as permitted by law (for example, downloading your own reports for personal use).

10. Third‑Party Links and Services

  1. The Platform may contain links to third‑party websites, applications, ads or services, including payment gateways, labs, hospitals and content providers. These are provided for convenience only.
  2. We do not control, endorse, guarantee or assume responsibility for any third‑party content, products or services. Your use of third‑party websites or services is entirely at your own risk and subject to their terms and privacy policies.

11. Privacy and Data Protection

  1. We collect and process your personal and health information in accordance with our Privacy Policy, which explains what data we collect, how we use it, whom we share it with and what rights you have.
  2. By using the Platform or providing information, you consent to our handling of your data as described in the Privacy Policy and in compliance with applicable law.

12. Disclaimers

To the maximum extent permitted by law:

  1. The Platform and Services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy, reliability, non‑infringement or completeness.
  2. We do not warrant that:
    • The Platform will be uninterrupted, timely, secure or error‑free;
    • Any defects or errors will be corrected; or
    • The Platform or servers are free of viruses or harmful components.
  3. We make no representation or warranty regarding:
    • The suitability of any particular test or package for your specific health condition;
    • Clinical results or outcomes based on the Services; or
    • Behaviour, competence or acts/omissions of Service Providers or third‑party vendors.

13. Limitation of Liability

To the fullest extent permitted by applicable law:

  1. CureConnect, its partners, directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or relating to your use of (or inability to use) the Platform or Services.
  2. Our total aggregate liability for any and all claims related to the Platform or Services shall be limited to the total amount actually paid by you to CureConnect for the specific booking giving rise to such claim.
  3. We are not liable for:
    • Any error, delay or deficiency in services rendered by Service Providers;
    • Issues caused by telecom/internet providers, payment gateways, system failures or events beyond our reasonable control; or
    • Any decision you make based solely on information or reports obtained through the Platform without consulting a qualified healthcare professional.

14. Indemnity

You agree to indemnify, defend and hold harmless CureConnect, its partners, employees and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or access to the Platform or Services;
  • Your breach of these Terms or any applicable law; or
  • Any content or information you submit, post or transmit via the Platform.

15. Suspension and Termination

  1. We may, in our sole discretion, suspend or terminate your access to the Platform or any part of the Services, with or without notice, if we believe that:
    • You have violated these Terms or applicable law;
    • Your actions may cause harm, loss or legal liability to us, other Users, or Service Providers; or
    • For any operational, security or other valid business reason.
  2. On termination, all rights granted to you under these Terms will immediately cease, but provisions that by their nature should survive (including those relating to limitation of liability, indemnity, intellectual property and dispute resolution) shall remain in effect.

16. Changes to the Platform and Terms

  1. We reserve the right to modify, suspend or discontinue any part of the Platform or Services at any time, with or without notice.
  2. We may update these Terms periodically. The “Last updated” date at the top indicates the latest version. Continued use of the Platform after any changes constitutes your acceptance of the updated Terms.

17. Governing Law and Dispute Resolution

  1. These Terms shall be governed by and construed in accordance with the laws of India.
  2. Subject to applicable law, the courts at Vadodara, Gujarat, India shall have exclusive jurisdiction over all disputes arising out of or in connection with these Terms or the Services.
